Privacy Policy

1. General

  1. The parties to this Agreement (the "Privacy Policy") are You, (the "User"), and EDEN MEDIA, LLC (hereinafter referred to as "Eden Media", or the "Company"). As used in this Agreement, the terms "we" and "us" are also used interchangeably to refer to the Company or BOOBLEEARTH.COM (hereinafter referred to as "BoobleEarth.com", "BoobleEarth", the "Website", or "Site"); the term "You" and "Your" is used to refer to You, the User.
  2. Potential Advertisers – Some individuals access the Site for the purpose of applying to become an Advertiser on the Site (also referred to hereinafter as "Subscriber" or "Member"). These individuals are not considered "Users" as defined hereunder.
  3. This Privacy Policy describes how we use information received about you when you visit our Site or when you becoming a subscriber to, or otherwise use our online services. This Policy does not cover any information that we may receive from or about you through channels other than through the use of the Site.

2. Revisions To This Policy

We reserve the right to revise, amend, or modify this policy and our other policies and agreements at any time and in any manner. You should periodically check for any modifications of this Policy by re-visiting this web page and using the "refresh" button on your browser.

3. Personal Information That We Collect

Users of our Site and services will have multiple manners of interactivity with us. However, aside from information collected from Advertisers or Potential Advertisers, at the present time, and subject to our exclusive revision without prior notice, Users are not required to enter through any active data collection pages. Any information gathered is limited to cookies, IP Addresses and Referral URLs, and other passive information gathering devices, as explained below. We collect certain necessary information such as age, name, email and website addresses from Advertisers and Potential Advertisers. Our use of information collected from Advertisers is governed by provisions outlined in Section 11 and 12, below. We reserve the right to utilize information collected from Potential Advertisers during the application process, in accordance with the applicable provisions below.

4. How We Collect Information From You

  1. Passive Collection – We use cookies to collect information about you in order to enhance your experience on the site. The collection of these cookies is intended to improve site navigation; maintain tracking of visitor preferences; provide general internal and user web analytics reports; conduct research; and assist in identifying possible fraudulent activities. The information collected in our cookies includes, but is not limited to, your user IP address, browser information, geographic location and other session data.
  2. Active Collection – As stated above, the Site does not presently engage in any active collection of User data. The information referenced in Section 3 is collected from Potential Advertisers, during the application/submission process.

5. How We Use Your Information

The primary use for any information collected is to provide you with Site services. We also use your information to deliver customized services to you; for User support purposes; and for efforts to monitor and ensure against fraud, harassment and spamming. Non-personal and aggregate information, which is – as stated above – collected passively, is used in order to geographically customize our marketing efforts or to generally customize the use of our site for an aggregate group of customers. Information gathered from Potential Advertisers may be used to assist such individuals in completing the application/submission process, and for marketing and/or research purposes. Further, we do not provide User information to third parties; nor will we sell, rent or provide any of your information to other entities such as advertisers, or other companies selling services similar to this Company's services.

6. Special Cases

It is our policy not to use or share the passive information about Users in ways unrelated to those described in this Policy without also providing the User with an opportunity to opt out or otherwise prohibit such unrelated uses. However, we may disclose passively-collected information about Users, or information regarding your use of the Services or Web sites accessible through our Services, for any reason without notice if, in our sole discretion, we believe that it is reasonable to do so, including, but not limited to:

  1. To satisfy any laws, such as the Electronic Communications Privacy Act, regulations, or governmental, or legal requests for such information;
  2. To disclose information that is necessary to identify, contact, or bring legal action against someone who may be violating our Terms of Use and other policies and procedures;
  3. To operate our Services properly;
  4. To protect ourselves, our Users, and the general public. We specifically reserve the right to disclose any and all information to law enforcement in the event that a crime – including, but not limited to, fraud-related offense – is committed, is suspected, or if we are compelled to do so by lawful criminal, civil, or administrative process, discovery requests, subpoenas, court orders, writs, or reasonable request of authorities or persons with the reasonable power to obtain such process; and
  5. To cooperate with law enforcement authorities, and other governmental, administrative or regulatory agencies about our end users to the extent required by applicable law. Examples of such cooperation include lawful criminal, civil, or administrative process, discovery requests, subpoenas, court orders, or writs. We do not intend to cooperate with private-party litigants and others seeking information unless compelled to do so through lawful court or administrative process, such as subpoenas, court orders, or writs.

7. Transmittals from Us

If you provide your information to us or use the Site, you will have created a commercial relationship with us. Even though the Site presently opts not to provide Users, as described above, with e-mail advertising materials, your use of the Site and its services constitutes your understanding and consent that even unsolicited commercial email sent from us or our affiliates is not SPAM as that term is defined under the law. We may send our users e-mails or other notices regarding new services, promotions, or other information that may be of general interest. Users who no longer wish to receive materials from us may opt-out of receiving these communications by contacting us. We will comply will all requests for removal. The implementation of any changes to the preexisting practice will be reflected in the Site's Privacy Policy. We strongly advise our Users to periodically review the terms of this policy in order to stay apprised of any such changes.

8. Third-Party Advertisers

We aggregate (gather up data across all our members accounts) personally identifiable information and disclose such information in a non-personally identifiable manner to advertisers and other third parties for other marketing and promotional purposes. However, in these situations, we do not disclose to these entities any information that could be used to identify you personally. Certain information, such as your name, email address, password are never disclosed to marketing advertisers. We may use third-party advertising companies to serve ads on our behalf. These companies may employ cookies and action tags (also known as single pixel gifs or web beacons) to measure advertising effectiveness. Any information that these third parties collect via cookies and action tags is completely anonymous.

9. Public Forums

At the time of the institution of this Policy, the Site does not offer any public forums or blogs to Users. The Company reserves the right to offer public forum and blogging services in the future.

10. Our Commitment to Data Security

We take measures, including data encryption, to protect the transmission of all sensitive end-user information. We make every effort to ensure the integrity and security of our network and systems. Nevertheless, we cannot guarantee that our security measures will prevent third-party 'hackers' from illegally obtaining this information. We take all reasonable measures to prevent such breaches of security, but given the resourcefulness of cyber-criminals we are unable to guarantee that our security is 100% breach-proof. You assume the risk of such breaches to the extent that they occur despite our reasonable security measures.

11. Subscribers Content Appearing on BoobleEarth

WHILE WE ATTEMPT TO SCRUTINIZE AND POLICE ALL CONTENT FOR LEGALITY, WE ASSUME NO RESPONSIBILITY OR LIABILITY FOR ANY CONTENT ON BOOBLEEARTH.COM, NOR HOW ANY SUBSCRIBERS USE BOOBLEEARTH. BOOBLEEARTH IS NOT AN ESCORT AGENCY, NOR CAN WE, OR DO WE MAKE REFERRALS. IF YOU WISH TO CONTACT ANY OF THE INDIVIDUALS OR COMPANIES WHO ARE LISTED ON BOOBLEEARTH, PLEASE USE THE CONTACT INFORMATION FOUND IN THE LISTINGS YOU SEE THEM IN. The content of all subscribers and advertisers who appear on BoobleEarth.com is provided by independent or agency businesses who are solely responsible for their content including, without limitation, all text, photo, and contact information. The ads are provided for informational purposes only. BoobleEarth does not control, authenticate, investigate, verify, or endorse any of the content, information, except as it pertains by law as BoobleEarth will not condone the promotion of illegal activity. BoobleEarth assumes no responsibility or liability for any ad's content, representations, promise (explicit or otherwise), communications, by any subscriber or advertiser, including, without limitation, the accuracy, completeness, or truthfulness of the ads, or any part thereof.
